Wiggam, Swearingen Introduce Legislation to Require Employer Use of E-Verify Program

State Representatives Scott Wiggam and D.J. Swearingen have recently introduced legislation in Ohio that would mandate employers to use the E-Verify program. The E-Verify program is an internet-based system that helps employers verify the work authorization of new hires. This program aims to confirm an employee's eligibility for employment by checking federal records, including work permits, visas, and citizenship, all within a matter of seconds.

Wiggam expressed his belief that implementing the E-Verify program would protect Ohio's workforce by making it more difficult for human traffickers to exploit illegal workers. He stated, "Illegal labor trafficking hurts Ohio's workers." By requiring employers to use E-Verify, the legislation aims to address this issue and safeguard the livelihoods of Ohio's workforce.

Swearingen emphasized the benefits of the bill, stating that it would streamline the hiring process for employers while simultaneously empowering Ohio workers. The proposed legislation aligns with the ongoing efforts to address Ohio's workforce needs.

The bill sets forth several key provisions. Firstly, it would require all contractors and subcontractors working on public works construction projects to utilize the E-Verify program for their project workforce. Additionally, contractors and subcontractors involved in other construction projects would also be required to use E-Verify, except for those engaged in single, double, or triple family residential construction, as well as construction for agricultural purposes. Furthermore, employers with seventy-five or more employees would be mandated to use E-Verify.

The legislation is currently awaiting a bill number and assignment to a House committee. Once the bill is assigned, it will proceed through the legislative process, giving stakeholders an opportunity to provide input and express their support or concerns.

The introduction of this legislation highlights the importance of ensuring the integrity of Ohio's workforce and protecting workers' rights. If passed, the bill would provide a valuable tool for employers to verify the eligibility of their new hires and contribute to the overall wellbeing of Ohio's labor market.
